Buchanan, the Puget Sound Tug-Boat Company, Et Al., Appellees It is obvious and the lower Court found (transcript page 54) that that method of towing was dangerous. (page 207 of transcript). The tow commenced about p. M. At Tacoma, and was for the purpose of tow ing both vessels down Puget Sound and through the Straits of San Juan de Fuca to sea, at about 6: 30 p. M., at which time it was dark, rainy and a drizzling night, the vessels had approached Alki Point, when the tow boat, seeing a light ahead on her port bow, put the wheel of her vessel to port, which would cause her to sheer to starboard and blew some whistle signals. (page 406 of transcript). The tugboat swung about three pomts, to wit: about thirty-seven and one-half degrees, when she executed another maneuver and sheered back again. The Columbia followed as near as possible, but it appears that the Ravenscourt, which had been steer ing wildly during the tow, put her helm hard a-starboard which threw her on the Port side of the Columbia, when she should have been on the starboard, and the hawser of the Ravenscourt caught around thestarboard side of the Columbia, jammed her rudder and the latter vessel was unable to steer.
